1 – Preamble

PROMAN GESTION, a simplified joint stock company, registered in the Manosque Trade and Companies Register under number 490 673 423, whose registered office is located at Zone Industrielle Saint Maurice, 04100 Manosque (hereinafter “PROMAN”), publishes and operates the Internet platform accessible at the following address: https://www.proman.group (hereinafter “the Site”).

The Site presents the activities of PROMAN and, more broadly, those of the PROMAN Group (hereinafter “the Group”).

The purpose of the Site is to present the PROMAN Group, its activities, commitments and news. It also allows users to apply for job offers to join the PROMAN Group via the “Join us” page.

Any use of the Site implies unreserved acceptance of these General Terms and Conditions of Use (GTCU).

 

2 – Definitions

The following terms, whether used in the singular or plural in these GCTU, shall have the meanings defined below:

  • “General Terms and Conditions of Use” or “GTCU”: the present contractual terms and conditions made available on the Site’s home page, governing the use of the Site by any User.
  • “Data”: all information recorded, downloaded or entered by the User or by PROMAN’s teams on behalf of the User when using the Site. If this Data is personal, it is referred to as “Personal Data”.
  • “Group”: PROMAN and its various subsidiaries.
  • “Parties”: PROMAN and the Users.
  • “Services”: all services offered by PROMAN to Users via the Site, as defined in articles 8 and 9 herein.
  • “Site”: the Internet site accessible at https://www.proman.group, comprising all the web pages, services and functions offered to Users.
  • “Terminal”: connected computer device (computer, smartphone, tablet) with an internet connection and compatible with use of the Site.
  • “User”: any individual or legal entity visiting the Site, whether the connection is made directly or via a partner portal.

 

3 – Object

These GCTU define the rules for using the Site and govern access to the services offered, in particular the possibility for candidates to submit their application via the “Contact Us” page.

They set out the respective rights and obligations of the Parties in relation to the use of the Site and the Services offered therein.

The GCTU apply, without distinction or reservation, to all Users and to all Services provided by PROMAN on the Site.

The information appearing on PROMAN’s publications is given for information purposes only; these GTCU alone constitute the agreement between the Parties for the use of the Site.

The Parties declare that these GTCU do not create any legal entity or association between them and expressly exclude any notion of ‘affectio societatis’.

 

4 – Acceptance of the General Terms and Conditions of Use

Use of the Site and Services implies full and unreserved acceptance of these Terms and Conditions.

he User agrees to carefully read the GTCU each time they access the Site and is encouraged to print and retain a copy.

The GCTU are permanently accessible at the bottom of each page of the Site via a hypertext link and can be consulted at any time.

 

5 – Technical specifications

The User acknowledges that he/she has the necessary means and skills to use the functions offered on the Site.

The equipment required to access and use the Site is the sole responsibility of the User, as are any telecommunications costs incurred by their use.

The User undertakes to access the Site using a recent, virus-free Terminal, with an up-to-date, latest-generation browser.

 

6 – PROMAN’s role

The Site, published by PROMAN, presents the Group’s activities, history and values in a general and non-exhaustive manner.

 

7 – Access conditions

Any User may access the Site without prior registration.

 

8 – Description of Services

Any User may access the Site and its various functions free of charge.

The Site presents in a general and non-exhaustive manner the activities of PROMAN and more broadly of the Group. The Site also presents the specialized network of the PROMAN Group which Users can consult by clicking on the link to the dedicated sites.

PROMAN endeavours to provide information on the Site that is as complete and accurate as possible, but which remains purely indicative and is subject to change.

PROMAN cannot be held responsible for any omissions, inaccuracies or failure to update the information, whether caused by PROMAN or by third-party partners who provide the information.

 

9 – Recruitment and Application

The “Join Us” page allows Users to apply for job offers to join the PROMAN Group.

Data collected in this context:

When a candidate applies, PROMAN collects the following information:

  • First name, Last name
  • E-mail address, Telephone
  • Country of residence
  • Curriculum Vitae (CV)
  • Message from the candidate

This data is used exclusively to process applications for internal recruitment within the PROMAN Group.

Length of time applications are kept: Applications are kept for a maximum of 2 years after the last contact with the applicant, in accordance with CNIL recommendations.

 

10 – Intellectual Property

All content published on the Site, in particular texts, images, logos, videos, graphics, icons, as well as their layout, are protected by intellectual property laws and are the exclusive property of PROMAN or its partners.

Any reproduction, representation, modification, publication, transmission or adaptation, in whole or in part, of these elements without the prior written consent of PROMAN is strictly prohibited and is likely to constitute an infringement within the meaning of the articles of the Intellectual Property Code.

The User acknowledges that the use granted to him/her of the Site and its Services does not grant him/her any intellectual property rights over all the elements of the Site, apart from a strictly personal, non-exclusive right of use limited to browsing the Site.

 

11 – PROMAN’s liability

PROMAN makes every effort to ensure that the information published on the Site is accurate and up to date. However, PROMAN cannot guarantee the accuracy, completeness or relevance of this information. The User acknowledges that he/she uses this information under his/her sole responsibility.

PROMAN declines all responsibility in the event of:

Errors, omissions or inaccuracies in the information available on the Site,

Technical difficulties, temporary or permanent unavailability of the Site,

Use of the Site by a third party in breach of these GCTU,

Direct or indirect damage resulting from access to or use of the Site by the User.

The Site may contain hypertext links to other websites. PROMAN cannot be held responsible for the content, availability or practices of these third-party sites.

 

12 – Obligations of the User

The User undertakes to:

  • Comply with these Terms and Conditions of Use and the laws in force,
  • Not to infringe PROMAN’s rights or image,
  • Not to use the Site for fraudulent or harmful purposes,
  • Do not attempt to gain unauthorised access to computer systems linked to the Site.

Any misuse of the Site will result in access being restricted or withdrawn without notice.

 

13 – Personal Data and Cookies

The User is informed that PROMAN collects and processes his/her personal data in compliance with the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679) and the regulations in force.

The terms and conditions for the collection, use and protection of personal data are detailed in the Privacy Policy of the Site.

Candidates’ rights: In accordance with the regulations in force, all candidates have the following rights regarding their personal data:

  • Right of access: obtain a copy of the data communicated.
  • Right of rectification: amend incorrect or incomplete information.
  • Right to erasure: request the deletion of data under certain conditions.
  • Right of opposition and limitation: to restrict the processing of your data in certain cases.

Exercising your rights: Any request relating to personal data may be sent to [email protected] or by post to PROMAN GESTION – DPO, Zone Industrielle Saint Maurice, 04100 Manosque.

The User may also lodge a complaint with the CNIL via its official website www.cnil.fr.

The Site uses cookies and other tracking devices. The User may consult the Cookies Policy to find out about the purposes and methods of managing these cookies.

 

14 – Liability

PROMAN declines all responsibility in particular:

In the event of temporary inability to access the Site for technical maintenance or updating of published information. Users acknowledge that PROMAN may not be held liable in the event of malfunctions or interruptions of said transmission networks.

  • In the event of viral attacks or unlawful intrusion into an automated data processing system.
  • In the event of abnormal use or illicit exploitation of the Site by a User or a third party.
  • Regarding the content of third-party websites to which hypertext links on the Site refer
  • In the event of non-compliance with these GCTU attributable to Users.
  • In the event of delay or non-performance of its obligations, where the cause of the delay or non-performance is linked to a case of force majeure as defined in article 12 of these GCTU.
  • In the event of an external cause not attributable to PROMAN.
  • In the event of unlawful conduct by a User or breach of contract by a User.
  • In the event of abnormal use or unlawful exploitation of the Site, the User shall be solely liable for any damage caused to third parties and for the consequences of any claims or actions that may arise therefrom.

 

15 – Force Majeure

PROMAN cannot be held liable if the non-execution or the delay in the execution of one of its obligations described in these GCTU results from a case of force majeure.

Force majeure refers to any event beyond the control of a Party, which could not have been reasonably foreseen at the time of contract conclusion, and which prevents the affected Party from fulfilling its obligations.

If the impediment is temporary, performance of the obligation is suspended unless the resulting delay justifies termination of the contract. If the impediment is definitive, the contract is terminated ipso jure, and the parties are released from their obligations under the conditions set out in articles 1351 and 1351-1 of the French Civil Code.

In this respect, PROMAN may not be held liable in particular in the event of an attack by hackers, the unavailability of materials, supplies, spare parts, personal equipment or other; and the interruption, suspension, reduction or disruption of electricity or other or any interruption of electronic communications networks, as well as in the event of any circumstance or event beyond the control of PROMAN occurring after the conclusion of the GCTU and preventing its performance under normal conditions.

It is specified that, in such a situation, the User may not claim the payment of any compensation and may not bring any action against PROMAN.

In the event of one of the aforementioned events, PROMAN will endeavour to inform the User as soon as possible.

 

16 – Validity of the GCTU

If any one of the stipulations of these GCTU is declared null and void by virtue of a legislative or regulatory provision in force and/or a court decision having the force of res judicata, it will be deemed unwritten but will in no way affect the validity of the other clauses, which will remain fully applicable.

Under no circumstances does such a modification or decision authorise Users to disregard these Terms and Conditions of Use.

The headings and sub-headings of these GCTU are included for convenience only. By express agreement between the Parties, these headings and sub-headings may under no circumstances be used to interpret any provision whatsoever.

The fact that a Party does not claim the application of any provision of these GCTU or tolerates its non-execution on a temporary or permanent basis may not under any circumstances be interpreted as a waiver by that Party of its rights hereunder. The fact that a party tolerates the non-performance or imperfect performance of the GCTU or, more generally, tolerates any act, abstention or omission by the other party that does not comply with the provisions of these GCTU shall not confer any right whatsoever on the party benefiting from such tolerance.

 

17 – Security

PROMAN implements all the technical and organisational measures necessary to guarantee the security and confidentiality of the data processed on the Site.

Any attempt at fraudulent access, alteration or disruption of the operation of the Site is prohibited and may result in legal action.

 

18 – Modification of the GCTU

PROMAN reserves the right to modify these GCTU at any time to adapt them to legal, technical or functional changes to the Site.

Changes will be published on the Site and will come into force as soon as they are put online. Users are advised to consult this page regularly to stay informed of any updates.

 

19 – Applicable Law and Jurisdiction

These GCTU are governed by French law.

In the event of a dispute relating to the interpretation or execution of these GCTU, the Parties shall endeavour to reach an amicable solution. Failing this, the dispute shall be submitted to the exclusive jurisdiction of the competent courts around PROMAN’s registered office.
